MEDPAC RESPONSE LETTER TO CMS

In the proposed final rule to the 2010 Medicare Physician Fee Schedule (MPFS), CMS used MedPAC's recommendation regarding machine utilization for diagnostic imaging equipment as its rationale to alter the machine utilization formula for all pieces of equipment valued at over $1 million. In its comments to CMS regarding the 2010 MPFS, MedPAC specifically indicated that it "did not contemplate applying this policy to radiation therapy machines."
